XERIMIS INC., XERIMIS LTD., and XERIMIS B.V. (in this document collectively referred as “XERIMIS” or “we” or “our” or “us”) are committed to preserving the privacy of all individuals that share their information with XERIMIS as a global service provider of clinical packaging services.   This Privacy Policy governs our website, www.xerimis.com(the “Site”) operated by XERIMIS and sets forth the types of personal information that we collect; how we use any personal information; to whom and under what circumstances we disclose that information; and the steps which are taken to protect the information that you provide to us. The Privacy Policy also sets out how XERIMIS complies with data privacy laws and regulations, including but not limited to the EU General Data Protection Regulation (Regulation (EU) 2016/679) (“GDPR”).

By registering on any XERIMIS site, you consent to the collection, use and transfer of your information under the terms of this policy.

  1. COLLECTION OF PERSONAL INFORMATION

Information You Give to XERIMIS

XERIMIS collects personal information relating to an identified or identifiable person provided by individuals who visit our Site, for example when making an enquiry or seeking employment.  When you visit or register on the Site, you may be asked to voluntarily provide certain information about yourself, including your name, postal address, email address and phone number. When you apply for employment the Site, we also collect any personal information included on your resume. We may also collect information about you from e-mails, letters or business cards you provide to us.

In some jurisdictions, individuals may have the right to withdraw consent from certain uses. If you reside in such jurisdictions, you may have additional rights which are detailed below, “Your European Privacy Rights.”

Information Collected Automatically

When you visit the Site, we may collect certain information from you, including your Internet Protocol (IP) address, MAC address, browser type, operating system, device identifying information, the specific web pages visited during your connection, and the domain name from which you accessed the Site. In addition, we may collect information about your browsing behavior, such as the date and time you visit the Site, the areas or pages of the Site that you visit, the amount of time you spend viewing the Site, the number of times you return to the Site and other clickstream data. We may also use non-personal or aggregated information for statistical analysis, research, and other purposes.

We may use the information about you for purposes described in this Privacy Policy or disclosed to you on the Site.  For example, we may use information about you to:

  • Process your employment application;
  • Respond to your enquiries;
  • Contact you for your views on our services and to notify you occasionally about important changes or developments to the Site or our services.
  • Where you have consented, to let you know about other products and services which we offer which may be of interest to you and we may contact you by post, telephone or fax, as well as by e-mail. If you change your mind about being contacted in the future, please let us know, either by availing of the “unsubscribe” option in our marketing-related correspondence or by contacting us directly via email.
  • Tailor your experience at our Site, showing you content that we think you might be interested in, and displaying the content according to your preferences.

XERIMIS do not rent or sell your personal information with nonaffiliated companies or their employees, except to provide services you have requested, when we have your permission, or under the following circumstances:

With Our Staff or Third Parties

The information you provide to us may be held on our computer systems in the UK (or in respect of information provided to our affiliates outside the UK, in the jurisdictions where those affiliates are established). This information may be accessed by, or given to our staff or other third parties (including third party service providers) working either within or outside the UK, for the purposes set out in this policy or for other purposes approved by you. At times, personal information will be shared by XERIMIS with companies working as agents of XERIMIS and third parties strictly on a “need to know” basis and to satisfy business requirements. XERIMIS does not trade or sell any personal information.

With Other Parts of Our Business and Our Business Partners

Personal information collected by any part or department of our business will be used in accordance with this Privacy Policy and may be shared with other parts or departments of our business and with our business partners, including third parties, for use in accordance with this Privacy Policy.

In Connection with Business Transfers

If our business enters into a joint venture with or is sold to or merged with another business entity, your information may be disclosed to our new business partners or owners.

To Comply with Laws

Under certain circumstances, XERIMIS may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

XERIMIS may from time to time collect information from you by using “cookies”. At XERIMIS, we are strongly committed to protecting your privacy and as such we want to ensure that you are always aware of how we are using cookies on our Site and how this may affect you.

You can navigate around our Site without giving us any personal information.  However, the cookie policy in this section sets out a brief explanation explaining our practices for the occasions where cookies are used.

WHAT ARE COOKIES?

A cookie is a text file that is placed on your computer, mobile phone or tablet by the websites. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you and can only be read by a web server in the domain that issued the cookie to you.  You may choose to decline cookies if your browser permits, but doing so may affect your use of our Site, for example your ability to access certain features of the Site.

HOW WE USE COOKIES

Xerimis uses cookies to improve services for you by:

  1. Measuring how many people are using the different areas of the websites so that popular sections can be improved.
  2. Analyzing anonymous data to help us understand how visitors interact with the websites so we can improve the services offered.
  3. Enabling a service to recognize your computer so you don’t have to give the same information several times during one task.

Cookies may be used on our customer facing applications, and although we are not actively storing any information pertaining to the user in a form of a cookie. Cookies do not usually contain personally identifiable information, and if at times XERIMIS requires you to register your information, the cookie which is associated with your registration information is used in a limited manner to allow XERIMIS to offer increased functionality of our websites.  We do not share any of our data with any third parties. The personal or system information is not stored in the cookie.

XERIMIS also uses industry standard web analytics to track web visits, Google Analytics. The information generated by the cookie about your use of our Site (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of our Site, compiling reports on website activity for website operators and providing other services relating to website activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. Google will not associate your IP address with any other data held by Google.   1. LINKED SITES

Our Site may contain links to other sites for organizations that are not directly affiliated with XERIMIS.  Also, XERIMIS may have a presence on one or more social-networking sites to which you may have access. We are not responsible for the content or privacy practices of these sites, and recommend that you review their privacy statements as they may differ from those of XERIMIS.

  1. DO NOT TRACK

Do Not Track (DNT) is a privacy preference that users can set in some web browsers, allowing users to opt -out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, XERIMIS and the Site do not recognize DNT. For more information regarding your choices regarding tracking, see the “Cookies” section, above.

  1. YOUR CALIFORNIA PRIVACY RIGHTS

If you are a resident in California, you have the right to request once a year information regarding entities with which XERIMISmay have shared your personal information for those entities’ own direct marketing purposes during the past calendar year. To make this request, please contact us as explained below.

  1. YOUR EUROPEAN PRIVACY RIGHTS

If you are a European resident, to the extent that you reside in Europe (only), you have certain rights in relation to your personal information under the applicable European data privacy laws. This European Privacy Rights section only applies to such individuals. Once any such individuals come to the US, this section no longer applies to any additional personal information provided about them to XERIMIS. Under applicable European data privacy laws, XERIMISis the data controller.

(a)       Rights to control your personal information

Applicable European data privacy laws gives certain individuals the right to access their personal information. Your right of access can be exercised in accordance with the European data privacy laws. If you would like to request a copy of your personal information being held by us, or request that it is deleted or to update and/or correct your personal information or request that we provide a copy to another data controller of your personal information that you have provided to us, please contact us. We will need enough information to ascertain your identity as well as the nature of your request. We will aim to respond to your request within one calendar month of receipt of the request. Where we were unable to do so within the calendar month, we will notify you of the soonest practicable time within which we can respond to your request (and within three months from the date of your request). There are certain exemptions and restrictions of these rights under the European data privacy laws that enable personal information to be retained, processed or withheld from access and we will inform you of these if applicable. We use your personal information for the following key purposes:

  • to contact you: subject to applicable law, we and/or our third-party service and business providers may contact you and send you communications relating to your employment application or our services. Where required under applicable data privacy laws, we will not send you marketing communications without your prior consent;
  • for legal purposes: we may use and share personal information for legal purposes, including financial, regulatory, tax and other legal obligations and to respond to governmental or regulatory requests or subpoenas or for litigation purposes;
  • for our legitimate interests and those of a third party: we may use your personal information to manage our legal, regulatory, financial and business requirements, including obtaining legal advice, in the course of disputes and litigation, internal and/or regulatory investigations and other legitimate interests;
  • for our business purposes: we may use your personal information to help us manage the lawful requirements of our business;
  • for other purposes: subject to applicable law, we may use your personal information for additional purposes in connection with the website or our organization, where you have provided your prior consent.

(b)       International transfers

XERIMIS is a global service provider with sites and operations worldwide and the Site is hosted in the United States.  Your personal information will be processed by us and by our services providers in the US (which may have less stringent data privacy laws compared to those in your country of residence) and we also transfer your personal information to the recipients described in this Privacy Policy in countries which may also have a less stringent standard of data privacy laws compared to those in your country of residence. Where this occurs, you acknowledge and where applicable, consent to such transfer in accordance with this Privacy Policy.

(c)        Sharing your personal information

We share your personal information with third parties to help us use your personal information, as described in the Privacy Policy and in addition, we may need to share your personal information with our professional tax, legal, audit or financial advisors. We may also share your personal information when we receive requests for information in the context of legal disputes, investigations regulatory enquiries or similar requests.

(d)       Retention of personal information

We will only retain your personal information for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal requirements. To determine the appropriate retention period, we consider the amount, nature and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we process your personal information and whether we can achieve those purposes through other means, and applicable legal requirements.

If you have any concerns regarding how we are handling your personal information, please contact us. We will strive to deal with your concerns promptly. If you wish to complain about the handling of your personal information outside of XERIMIS, you have the right to raise a complaint with a supervisory authority in your country of residence under European data privacy laws.

  1. CHILDREN’S PRIVACY

Under Age 13

XERIMIS does not knowingly collect personal information from children under 13 years of age without verifiable parental consent.  If we learn that a child under the age of 13 has submitted personally identifiable information online without parental consent, we will take all reasonable measures to delete such information from our databases and to not use such information for any purpose (except where necessary to protect the safety of the child or others as required or allowed by law).  If you become aware of any personally identifiable information we have collected from children under 13, please contact us as set forth below.

Under Age 18

Minors under 18 years of age may have the Personal Information that they provide to us through the Site deleted by sending an email to us requesting deletion.  Please note that, while we make reasonable efforts to comply with such requests, deletion of your personal information does not ensure complete and comprehensive removal of that data from all systems.

Under applicable European Data Privacy Laws, children between the age of 13 to 16 may provide valid consent to process their personal information. Where consent is required under such European Data Privacy Laws, you have the obligation to provide to us evidence of such consent or, as required under the European Data Privacy Laws, the authorization of the holder of parental responsibility for the child. We may refuse to process, or continue to process, the child’s personal information until we receive this evidence of consent or authorization.
